1. Who provides the service

Avantium is provided by Avantium AI LLC, 16192 Coastal Highway, Lewes, DE 19958, USA ("we"). By creating an account or using the app you accept these terms.

2. What Avantium is, and who it is for

Avantium is a management tool for trades businesses and professionals. It is intended for professional, not household, use. You must be of legal age and able to enter into a contract, and if you act for a company, authorised to do so.

3. Price

In this version Avantium is provided free of charge. There are no in-app purchases and no subscriptions. If we introduce paid plans in future we will tell you well in advance, and you will never be charged without agreeing first.

4. Your account

You sign in with your email and a one-time code; there is no password. You are responsible for keeping access to that mailbox and for what is done from your account. If you give access to your team, you are responsible for their use.

5. Your content and your customers' data

What you upload stays yours. You authorise us only to host and process it so we can provide the service.

If you store your customers' data, you are the controller of that data: it is for you to inform them and to have a lawful basis for processing. We act as processor and use it only on your instructions, as set out in the privacy policy.

6. Acceptable use

You may not use Avantium for unlawful activity, to store content you have no right to keep, to attempt access to other people's accounts, to overload or damage the service, or to resell it as your own.

If you use the location feature with employees, it is for you to inform them and to comply with the employment and data protection rules that apply to you. In Spain, location-based monitoring carries specific prior-notice requirements.

7. Availability

We work to keep the service available, but there may be interruptions for maintenance or causes beyond our control. We do not guarantee uninterrupted or entirely error-free operation.

8. Backups

We take regular backups, but you should download anything important. The app can export quotes and invoices as PDFs.

9. Liability

Avantium supports your administration; it does not replace tax, employment or legal advice. The figures, taxes and documents you issue are your responsibility and you should check them before sending.

To the extent the law allows, we are not liable for lost profit, lost business or indirect damage. None of this limits liability that cannot lawfully be excluded, nor any consumer rights that may apply to you.

10. Closing your account

You may leave at any time by following Delete account. We may suspend an account that breaches these terms, with notice unless the seriousness of the breach prevents it.

11. Intellectual property

The app, its name, brand and design belong to Avantium AI LLC. These terms grant you no rights over them beyond using the app.

12. Changes to these terms

We may update them. If a change is material we will tell you before it takes effect, and you may close your account if you do not accept it.

13. Governing law

These terms are governed by the laws of the State of New Mexico, United States, without prejudice to the mandatory consumer protection rules of your country of residence.
